ArtFlicks (the "Platform") is an AI-powered image generation service that allows users to create, edit, and enhance images using artificial intelligence technology. By using the Platform, you agree to be bound by these Terms and Conditions.

These terms govern your use of our AI image generation services, including but not limited to text-to-image generation, image editing, inpainting, upscaling, and real-time generation features. (Note: Video, voice, and like features are not yet added to the platform)

ArtFlicks is a platform that allows users to access a suite of web tools powered by artificial intelligence in order to generate visual media for use in a variety of contexts.

You may be required to sign up for an account, select a password and user name ("ArtFlicks Credentials"), and provide us with certain information or data, such as your contact information. You promise to provide us with accurate, complete, and updated registration information about yourself. You may not select as your ArtFlicks Credentials a name that you do not have the right to use, or another person's name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission.

Additionally, you may be able to access certain parts or features of the Services by using your account credentials from other services (each, a "Third Party Account"), such as those offered by Google and Discord. By using the Services through a Third Party Account, you permit us to access certain information from such account for use by the Services. You are ultimately in control of how much information is accessible to us and may exercise such control by adjusting your privacy settings on your Third Party Account.

You represent and warrant that you are an individual of legal age to form a binding contract (or if not, you've received your parent's or guardian's permission to use the Services and have gotten your parent or guardian to agree to these Terms on your behalf). If you're agreeing to these Terms on behalf of an organization or entity, you represent and warrant that you are authorized to agree to these Terms on that organization's or entity's behalf and bind them to these Terms (in which case, the references to "you" and "your" in these Terms, except for in this sentence, refer to that organization or entity).

You may use the Services for personal or professional purposes, subject to the terms, conditions and any other limitations outlined in these Terms and your specific subscription tier, or any additional terms or agreements you enter with ArtFlicks (to the extent applicable). ArtFlicks may allow you to commercialize certain Content generated from the Services, subject to your adherence to our copyright dispute policy and any other restrictions or requirements (including pricing changes) imposed by ArtFlicks. All use of the Services must comply with applicable laws. You are solely responsible for ensuring that your use of the Services, including any commercial use of the Content, adheres to all relevant laws and regulations. We cannot be held responsible for any illegal or unauthorized use of the Services. ArtFlicks reserves the right to modify the terms of commercial use of Content generated from the Services at any time.

You will not share your ArtFlicks Credentials, account or password with anyone, and you must protect the security of your ArtFlicks Credentials, account, password and any other access tools or credentials. You're responsible for any activity associated with your ArtFlicks Credentials and account.

• The Platform is available for use by individuals and organizations who are at least 13 years of age.
• To use the Platform, you must create an account by providing accurate information including name, email address, and password.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities performed under your account.
• You must not share your account credentials with others or allow unauthorized access to your account.

Our Platform provides various AI-powered image generation capabilities:

• Text-to-Image Generation: Create images from text descriptions using advanced AI models
• Image Editing & Inpainting: Modify existing images by adding, removing, or altering elements
• Image Upscaling: Enhance image resolution and quality using AI algorithms

Acceptable Content: Our Platform is designed for creative, artistic, and commercial image generation. You may use our services to create:

• Artistic and creative imagery for personal or commercial use
• Marketing materials, advertisements, and promotional content
• Product mockups and design concepts
• Educational and training materials
• Entertainment and gaming content
• Abstract and conceptual artwork

Yes, there are important restrictions. To protect against misuse and ensure responsible AI usage, we have implemented comprehensive guardrails and restrictions across all AI tools (text, image, video, voice generation). (Note: Video and voice features are not yet added to the platform)

Reporting Violations: If you encounter content that violates these restrictions, report it immediately to support@artflicks.app. We investigate all reports within 24 hours and take immediate action against violators.

AI-Generated Content: You retain rights to images you generate using our Platform, subject to these terms and applicable laws.

Platform Technology: The Platform, including AI models, algorithms, and software, remains our intellectual property.

Third-Party Content: You must respect copyright and intellectual property rights when using our services.

Attribution: When sharing AI-generated content, you may be required to attribute the Platform as the source of generation.

The Platform collects and processes data to provide our services:

AI Content Disclaimer: All content generated through our Platform is created using artificial intelligence technology. Users are responsible for ensuring their generated content doesn't infringe on third-party rights, complies with applicable laws, and is used for legitimate purposes only.

AI Accuracy: AI-generated content may contain inaccuracies, errors, or unexpected results. We do not guarantee the accuracy, quality, or suitability of generated content for any specific purpose.

Content Responsibility: You are responsible for reviewing and verifying AI-generated content before use. We are not liable for any consequences resulting from the use of generated content, including but not limited to legal issues, copyright violations, or misuse.

AI Safety Measures: Our platform employs mandatory AI safety filters, content moderation systems, and guardrails that cannot be disabled. These systems are designed to prevent generation of prohibited content including impersonation, deepfakes, and harmful material.

Service Availability: We provide the Platform "as is" without warranties of any kind. We are not liable for any damages arising from service interruptions, technical issues, or AI model updates that may affect output consistency.

Payment Processor Compliance: By using our paid services, you acknowledge that our platform strictly prohibits generation of human-like faces without safeguards, deep fakes, face swaps, impersonation of real individuals, or content that could facilitate identity theft.

We reserve the right to terminate or suspend your account at any time for violations of these terms or for any other reason at our discretion.

Upon termination, your access to the Platform will be revoked, and we may delete your account data and generated content in accordance with our data retention policies.

You may terminate your account at any time through your account settings or by contacting our support team.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction where ArtFlicks operates.

Any disputes arising from these terms or your use of the Platform shall be resolved through binding arbitration or in the appropriate courts of our jurisdiction.

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on the Platform.

Your continued use of the Platform after changes constitutes acceptance of the modified terms. We will notify users of significant changes via email or platform notifications.
