ArtFlicks (the "Platform") is an AI-powered creative platform that allows users to create, edit, and enhance images, generate videos, clone voices, and create AI avatar content using artificial intelligence technology. By using the Platform, you agree to be bound by these Terms and Conditions.
These terms govern your use of our AI services, including but not limited to text-to-image generation, image editing, inpainting, upscaling, video generation, voice cloning, and AI avatar features.

ArtFlicks is a platform that allows users to access a suite of web tools powered by artificial intelligence in order to generate visual media, audio, and video content for use in a variety of contexts.
You may be required to sign up for an account, select a password and user name ("ArtFlicks Credentials"), and provide us with certain information or data, such as your contact information. You promise to provide us with accurate, complete, and updated registration information about yourself. You may not select as your ArtFlicks Credentials a name that you do not have the right to use, or another person's name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission.
Additionally, you may be able to access certain parts or features of the Services by using your account credentials from other services (each, a "Third Party Account"), such as those offered by Google and Discord. By using the Services through a Third Party Account, you permit us to access certain information from such account for use by the Services. You are ultimately in control of how much information is accessible to us and may exercise such control by adjusting your privacy settings on your Third Party Account.
You represent and warrant that you are an individual of legal age to form a binding contract (or if not, you've received your parent's or guardian's permission to use the Services and have gotten your parent or guardian to agree to these Terms on your behalf). ArtFlicks may allow you to commercialize certain Content generated from the Services, subject to your adherence to our copyright dispute policy and any other restrictions or requirements (including pricing changes) imposed by ArtFlicks. All use of the Services must comply with applicable laws. You are solely responsible for ensuring that your use of the Services, including any commercial use of the Content, adheres to all relevant laws and regulations. We cannot be held responsible for any illegal or unauthorized use of the Services. ArtFlicks reserves the right to modify the terms of commercial use of Content generated from the Services at any time.
You will not share your ArtFlicks Credentials, account or password with anyone, and you must protect the security of your ArtFlicks Credentials, account, password and any other access tools or credentials. You're responsible for any activity associated with your ArtFlicks Credentials and account.

Reporting Violations: If you encounter content that violates these restrictions, report it immediately to support@artflicks.app. We investigate all reports within 24 hours and take immediate action against violators.
AI-Generated Content: You retain rights to images, videos, and audio you generate using our Platform, subject to these terms and applicable laws.
Voice Likeness Rights: You retain ownership of your voice likeness. When you clone your voice, you grant ArtFlicks a limited license to process and store your voice data solely to provide the voice cloning service. This license terminates when you delete your voice clone or account.
Avatar Likeness Rights: You represent and warrant that you have the legal right to use any face image uploaded for AI avatar generation. You retain ownership of your likeness; however, by uploading a face image, you grant ArtFlicks a limited license to process the image solely to provide the AI avatar service.
Platform Technology: The Platform, including AI models, algorithms, and software, remains our intellectual property.
Third-Party Content: You must respect copyright and intellectual property rights when using our services.
Attribution: When sharing AI-generated content, you may be required to attribute the Platform as the source of generation.
Third-Party Providers: Voice cloning services are provided through third-party processors. Your use of voice cloning features is also subject to the terms of service of our voice processing providers. You may be required to accept additional terms before using voice cloning features.
The Platform collects and processes data to provide our services:

AI Content Disclaimer: All content generated through our Platform is created using artificial intelligence technology. Users are responsible for ensuring their generated content doesn't infringe on third-party rights, complies with applicable laws, and is used for legitimate purposes only.
AI Accuracy: AI-generated content may contain inaccuracies, errors, or unexpected results. We do not guarantee the accuracy, quality, or suitability of generated content for any specific purpose.
Content Responsibility: You are responsible for reviewing and verifying AI-generated content before use. We are not liable for any consequences resulting from the use of generated content, including but not limited to legal issues, copyright violations, or misuse.
Voice Clone Disclaimer: Voice clones are synthetic reproductions and may not perfectly replicate the original voice. You are solely responsible for ensuring you have proper consent and legal rights before creating or using voice clones. ArtFlicks is not liable for misuse of voice cloning features.
AI Avatar Disclaimer: AI-generated avatar videos are synthetic media. You are solely responsible for ensuring you have the legal right to use any likeness in avatar content. ArtFlicks is not liable for misuse of avatar features or unauthorized use of third-party likenesses.
AI Safety Measures: Our platform employs mandatory AI safety filters, content moderation systems, and guardrails that cannot be disabled. These systems are designed to prevent generation of prohibited content including impersonation, deepfakes, and harmful material.
Service Availability: We provide the Platform "as is" without warranties of any kind. We are not liable for any damages arising from service interruptions, technical issues, or AI model updates that may affect output consistency.
Payment Processor Compliance: By using our paid services, you acknowledge that our platform strictly prohibits generation of human-like faces without safeguards, deep fakes, face swaps, impersonation of real individuals, or content that could facilitate identity theft.
We reserve the right to terminate or suspend your account at any time for violations of these terms or for any other reason at our discretion.
Upon termination, your access to the Platform will be revoked, and we may delete your account data and generated content in accordance with our data retention policies.
You may terminate your account at any time through your account settings or by contacting our support team.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction where ArtFlicks operates.
Any disputes arising from these terms or your use of the Platform shall be resolved through binding arbitration or in the appropriate courts of our jurisdiction.
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on the Platform.
